1. Accounts

In order to purchase or generate quotation from www.ducklearning.com, you must register for an account with Duck Learning and provide certain information about yourself as prompted by the Web sites registration form. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; and (c) your use of the Web sites does not violate any applicable law or regulation or the terms of this Agreement.

You are responsible for maintaining the confidentiality of your Duck Learning Account login information. You are fully responsible for all activities that are associated with your Duck Learning Account (including but not limited to any purchases, use of the Web sites, or correspondence from your account to Duck Learning). You agree to immediately notify Duck Learning of any unauthorized use or suspected unauthorized use of your Duck Learning Account or any other breach of security. When you provide Duck Learning with such notice, Duck Learning will suspend or otherwise secure your Account to prevent future unauthorized activity.

By purchasing from www.ducklearning.com, you certify that you are least 18 years old. You further authorize Duck Learning directly or through third parties, to make any enquiries we consider necessary to validate your identity, billing and shipping address to protect you from credit card fraud and to ensure proper delivery of your products. This may include asking you for further information, requiring you to take steps to confirm ownership of your email address or financial instruments, and verifying your information against third party databases or through other sources. Any personal information collected for verification or during the transaction will remain confidential and will not be shared with third parties, with the exception of legitimate law enforcement authorities when a reasonable request is made.

2. Terms of Sale

2.1 How it works

Once you have ordered and paid for your goods in the webstore, Duck Learning will send you an e-mail confirming the receipt for your payment online, details of your order and details regarding delivery, providing that you submitted an accurate e-mail address when placing your order. We cannot guarantee that all the ordered goods are available in our inventory at all times but we will ship these as soon as possible.

2.2 Order Details
We encourage you to print or save a copy of these Conditions, your payment information for paying online and shipping confirmation e-mail immediately upon receipt, in case you need to contact us with any questions about your order. If you notice that any of the information emailed to you is incorrect please contact us immediately so we can correct it.

2.3 Products and Pricings
All prices stated are exclusive of 7% GST. 7% GST will be included only when checking out.

While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Delivery costs are as stipulated in the Shipping and Handling section and will be added to all orders.

Duck Learning reserves the right, at any time, to modify, suspend, or discontinue the sale of any Product or service with or without notice. You agree that Duck Learning will not be liable to you or to any third party for any modification, suspension, or discontinuance of any Product or service.

2.4 Portrayal of Product

While every effort has been made to portray items accurately, slight variations may occur. All measurements quoted are approximate and the reproduction of colors is as accurate as photographic and publishing processes will allow. Please note there may be variations in colors dependant on the calibration and settings of individual screens. LEGO Education makes reservations for any typing errors which may occur on the website.

LEGO, the LEGO logo, DUPLO, SOFT, and MINDSTORMS Education logos; the Brick and Knob configurations and the Minifigure are trademarks of the LEGO Group.

2.5 Payment

For each Product or service you order on the Webstore, you agree to pay the price applicable for the Product or service as of the time you submitted your order (“Product Price”), the delivery fees for the delivery service you select “Delivery Fees”), and 7% GST.

Duck Learning will automatically bill your credit card or PayPal account submitted as part of the order process for such amounts, and you hereby authorize us to do so.

All payments are non-refundable (except as expressly set forth in Section 2.3). We will only fulfil your order once we’ve received the full payment.

Successful completion of payment does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.

2.5.1 Payment using PayPal

Users of PayPal will forfeit the transaction fees incurred by both the seller AND the buyer if a cancellation of order or/and refund is initiated. PayPal charges users and merchants the transaction fees even for refunds.

The transaction fee rate differs from country to country but is around 3.90% + SGD0.50 per transaction.

We highly recommend customers to use VISA/Mastercard, bank transfer or Stripe to make payment instead of PayPal to prevent being charged the transaction fees even if the order is not fulfilled.

2.6 Delivery

Delivery is only made to addresses in Singapore. All deliveries will be fulfilled by a 3^rd party vendor. Delivery will usually take 3-5 days and are estimates. Duck Learning makes every effort to deliver goods within the estimated timescales; however delays are occasionally inevitable due to unforeseen factors. Duck Learning reserves the right to make deliveries in instalments. Duck Learning will send you an email when your order is shipped.

By completing your order on our webstore, you certify that you have verified your delivery address as being accurate and complete. You additionally confirm that an authorized person will be available at that address on the estimated delivery date.

Duck Learning shall not be liable for any damages or claims related to delayed shipments. If you must have a product by a certain date, we strongly encourage you to self-collect the order from our office.

2.7 Products Return Policy 

1. a) Damaged Products: If the Product arrives damaged (“Damaged Product”), Duck Learning will accept returns for a full refund only in accordance with the Return Procedures below. Provided that Duck Learning confirms that your Product was a Damaged Product and was returned in accordance with the Return Procedures below, your sole and exclusive remedy is that (a) we will issue a refund to your credit card or PayPal account in the amount charged for the Damaged Product (if your credit card has already been charged for the Product) or (b) we will not charge your credit card or PayPal account for the Damaged Product. The refunded amount will include the applicable Delivery Fee.
2. b) Return Procedures: All returns must be made within 14 days after the Product shipment date. All returned Products must be unused and returned in its original packaging. You are solely responsible for the cost of shipping the returned Product. All Products not returned in accordance with the Return Procedures shall be sent back to you, and no credit or refund will be issued. If returning items to us by post, you are strongly advised to obtain proof of posting. We cannot accept responsibility for parcels lost in transit.

Duck Learning assumes no liability other than what follows of statutory legislation. Duck Learning cannot in any event be held liable for any indirect or consequential losses, including but not limited to loss of or damage to data through use of any Duck Learning web site.

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Duck Learning, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
